1. OVERVIEW AND ACCEPTANCE

HI-NEW-TEX is operated by Shanghai G-trek Brand Gear Co., Ltd. The terms “HI-NEW-TEX,” “we,” “us,” and “our” refer to Shanghai G-trek Brand Gear Co., Ltd.

We operate this website, online store, and all related information, content, features, tools, products, and services, collectively referred to as the “Services.” Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

These Terms of Service, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any product-specific warranty or safety information published on this website, govern your access to and use of the Services.

By visiting, browsing, creating an account, or placing an order through the Services, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you should not access or use the Services.

2. ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your state, province, or place of residence to place an order through the Services.

The Services are not intended for children to create accounts, submit personal information, or place orders without the involvement and supervision of a parent or legal guardian.

You agree to provide accurate, current, and complete account, billing, payment, and shipping information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. Please contact us promptly if you believe your account has been accessed or used without authorization.

We may suspend or terminate an account if we reasonably believe that it is being used unlawfully, fraudulently, or in violation of these Terms.

3. PRODUCTS, DESCRIPTIONS, AND SAFE USE

We make reasonable efforts to display product descriptions, measurements, materials, colors, photographs, and specifications accurately.

Actual colors and product appearance may vary slightly due to screen settings, lighting conditions, production batches, material characteristics, or manual measurements. Minor variations do not constitute a product defect where the product remains materially consistent with its description.

Product availability, packaging, specifications, designs, colors, and materials may change without prior notice. We may limit purchase quantities or discontinue products at any time.

You are responsible for reviewing and following all product instructions, labels, warnings, manuals, setup instructions, maintenance guidance, and usage limitations.

Where product-specific instructions conflict with general information on the website, the product-specific instructions will apply.

Unless expressly stated otherwise:

• Tents, tarps, and shelters are intended for recreational and light outdoor use. They are not designed for extreme weather, technical expeditions, emergency shelter, or life-safety applications.
• Inflatable furniture is not a flotation device, lifesaving device, climbing aid, or children’s toy.
• Products used around children must be assembled, operated, and supervised by a responsible adult.
• Customers are responsible for selecting products suitable for their intended environment and checking weather, terrain, ventilation, anchoring, inflation pressure, and product condition before and during use.

4. ORDERS AND ORDER ACCEPTANCE

When you place an order, you are making an offer to purchase products from HI-NEW-TEX.

An automated order confirmation acknowledges that we have received your order but does not necessarily mean that the order has been accepted. An order is accepted when we confirm fulfillment or shipment.

We may refuse or cancel an order before shipment for reasons including:

• Product unavailability
• Payment failure
• Suspected fraud or unauthorized payment
• Incorrect pricing or product information
• Shipping restrictions
• Unusual order quantities
• Suspected commercial resale or export
• Other circumstances that prevent us from fulfilling the order

If we cancel an order after payment has been received, we will refund the amount charged for the cancelled product.

Please review your order information and shipping address carefully before submitting your order.

Cancellation and address-change requests should be submitted within 24 hours of purchase and before fulfillment begins. We cannot guarantee that an order can be changed or cancelled once processing or shipment has started.

Unless otherwise agreed in writing, products are sold for personal or household use and not for commercial resale or export.

5. PRICES, PAYMENT, TAXES, AND PROMOTIONS

The price charged for a product will be the price displayed at checkout when the order is placed, subject to the correction of obvious pricing or listing errors.

Prices, promotions, discounts, and product availability may change without prior notice.

Standard shipping is currently provided at no additional charge for eligible orders delivered within the United States, unless otherwise stated at checkout.

Any applicable taxes, duties, shipping charges, or additional fees will be displayed at checkout or explained in the order confirmation.

Where checkout or the order confirmation expressly states that import duties and taxes are included or that the shipment is delivered-duty-paid, we will arrange payment of the stated import charges.

You authorize us and our payment service providers to charge the payment method submitted for the total amount displayed at checkout.

You represent that you are authorized to use the payment method provided.

Promotions may be subject to separate conditions. If promotional conditions conflict with these Terms, the promotional conditions will apply to that promotion.

6. SHIPPING AND DELIVERY

We currently fulfill online orders for delivery within the United States.

Orders may be fulfilled and shipped directly by our fulfillment partners in China or from another disclosed fulfillment location.

Most orders are expected to arrive approximately seven business days after the order is accepted.

Delivery times are estimates and are not guaranteed. Processing or delivery may take longer because of circumstances including:

• Remote delivery destinations
• Carrier capacity
• Customs processing
• Severe weather
• Public holidays
• Incorrect or incomplete addresses
• Oversized product handling
• Transportation disruptions
• Events outside our reasonable control

When tracking information is available, it will be sent after shipment. Tracking information may take time to update after the carrier receives the parcel.

If we become aware that an order cannot be shipped or delivered within the stated or reasonably expected period, we will contact the customer and provide available options, which may include accepting the delay or cancelling the unshipped order for a refund.

Risk of loss and ownership of the product pass to the customer when the order is delivered to the shipping address shown in the carrier’s delivery record, except where applicable law requires otherwise.

Customers are responsible for providing an accurate shipping address and a secure, accessible delivery location.

Large or bulky products may require specialized packaging, carriers, or delivery arrangements. Any additional charge related to an unusual destination or delivery request will be disclosed before it is charged.

7. DELIVERY PROBLEMS

Please inspect your order promptly after delivery.

If an order is lost, arrives damaged, contains the wrong product, or is materially incomplete, contact us as soon as reasonably possible at:

• A description of the issue
• Photographs or video of the product
• Photographs of the packaging
• A photograph of the shipping label
• Any other relevant information reasonably requested by us

Please retain the product and all original packaging until the claim has been reviewed.

We may request additional information reasonably necessary to investigate the issue with the carrier, fulfillment partner, or manufacturer.

A carrier’s “delivered” status does not prevent us from reviewing a timely report of non-receipt. However, we may require confirmation of the shipping address, a carrier investigation, or other reasonable supporting information.

8. RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, cancellations, and exchanges are governed by our Return & Refund Policy published on this website.

The Return & Refund Policy forms part of these Terms of Service.

Nothing in these Terms limits any cancellation, refund, replacement, repair, or other consumer right that cannot lawfully be excluded.

9. PRODUCT WARRANTIES

A product includes a written limited warranty only where a warranty is expressly stated on the product page, warranty information page, product packaging, or accompanying documentation.

Any written warranty is governed by its stated:

• Duration
• Conditions
• Exclusions
• Claim procedure

Unless a product-specific warranty expressly states otherwise, warranty coverage does not include:

• Normal wear and tear
• Cosmetic changes
• Improper use
• Punctures or cuts
• Overinflation

• Unauthorized repairs or modifications
• Failure to follow product instructions

Nothing in these Terms excludes or limits statutory consumer rights or implied warranties where those rights cannot lawfully be excluded or limited.

10. INTELLECTUAL PROPERTY

The Services and their content, including text, photographs, graphics, videos, product designs, logos, trademarks, trade dress, software, and page layouts, are owned by or licensed to HI-NEW-TEX and are protected by applicable intellectual property laws.

We grant you a limited, revocable, non-exclusive, and non-transferable right to access and use the Services for personal, non-commercial shopping purposes.

Without our prior written permission, you may not:

• Modify or create derivative works
• Distribute or sell website content
• Use product photographs for commercial purposes
• Copy product descriptions

HI-NEW-TEX names, logos, product names, designs, and slogans may not be used without prior written permission.

• The User Content is accurate to the best of your knowledge
• The User Content does not violate any law
• The User Content does not infringe intellectual property, privacy, publicity, or other rights
• You have disclosed any free product, discount, payment, incentive, employment relationship, or other material connection related to a review or endorsement

We may moderate, refuse, edit, or remove User Content that we reasonably believe is unlawful, misleading, fraudulent, abusive, irrelevant, infringing, or inconsistent with these Terms.

We are not required to publish, respond to, or retain User Content.

12. THIRD-PARTY SERVICES AND LINKS

The Services may include payment services, applications, embedded content, social-media integrations, tools, or links provided by third parties.

We do not control third-party services and are not responsible for their availability, accuracy, security, content, terms, or privacy practices.

13. RELATIONSHIP WITH SHOPIFY

Shopify provides the ecommerce platform used to operate the Services.

Purchases made through our store are transactions directly between the customer and HI-NEW-TEX.

HI-NEW-TEX, rather than Shopify, is responsible for:

• Products sold through the store
• Order fulfillment
• Shipping
• Customer service
• Returns and refunds
• Product warranties
• Product-related claims

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for any sale, product, injury, loss, damage, or dispute between the customer and HI-NEW-TEX.

14. PRIVACY

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy published on this website.

Because the Services are hosted by Shopify and use third-party service providers, personal information may be processed by Shopify, payment providers, fulfillment partners, shipping carriers, analytics providers, customer-service providers, and other vendors as described in our Privacy Policy.

You may use the Services only for lawful purposes.

• Replacement costs
• Loss of opportunity

To the fullest extent permitted by law, our total liability for a claim relating to a product or order will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be excluded or limited, including liability arising from fraud, willful misconduct, gross negligence, or personal injury where applicable law prohibits limitation.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

19. INDEMNIFICATION

Before starting formal legal proceedings, you and HI-NEW-TEX agree to make a reasonable, good-faith effort to resolve the dispute by providing the other party with sufficient information to understand the issue and the requested resolution.

22. GENERAL TERMS

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

Our failure to enforce any provision does not constitute a waiver of that provision or any other right.

You may not assign or transfer your rights or obligations under these Terms without our prior written permission.

We may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or transfer of the Services.

These Terms and the policies incorporated into them represent the entire agreement between you and HI-NEW-TEX regarding your use of the Services.

Product-specific warranties, promotional terms, and written agreements remain separately enforceable according to their terms.

23. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on this page and updating the “Last updated” date.

Where required by applicable law, material changes will be communicated through the website, email, or another appropriate method.

Changes apply prospectively and do not alter the conditions governing an order already accepted unless required by law or agreed by both parties.

Your continued use of the Services after updated Terms take effect constitutes acceptance of the revised Terms.
